SOUTH BERWICK TOWN COUNCIL
PUBLIC HEARING
NON-STORMWATER DISCHARGE ORDINANCE
NOVEMBER 27, 2006
Chairman Suzanne Roberge opened the hearing at 6:35pm. Councilors present included Robert Gagne, Michelle Kareckas, Norma Tutelian, and Jean Demetracopoulos. Town Manager Jeffrey A. Grossman was also in attendance.
The purpose of the hearing was to receive public comment on the proposed Non-Stormwater Discharge Ordinance. Ms. Roberge read the purpose and objectives portion of the ordinance.
Jim Fisk, Planner, explained that the Planning Board held their public hearing and is recommending that the Council adopt the ordinance town wide.
Richard Clough, Academy Street, asked if there are any associated costs to the town regarding upgrades or new system installations, especially in the “back” areas of town. He also asked if the ordinance would cover drainage systems in the new subdivisions. Mr. Fisk explained that the town is not required to upgrade or install any systems. The ordinance would cover subdivisions whether the town owns the roadway or not.
Mrs. Demetracopoulos suggested a language change to section 96.5B. She recommended adding language that would allow the discharges at surface level only. Joe Rousselle, CEO, stated that it would not be an issue and was comfortable with enforcing the ordinance as it is written by MMA.
Mr. Gagne stated that this appears to be an unfunded mandate. Mr. Fisk stated the change is jurisdictional from Federal to State to local. The change allows the town to enforce the ordinance and assess fees & fines.
The hearing was closed at 6:49pm.
