SOUTH BERWICK ZONING BOARD OF APPEALS
PUBLIC HEARING
JANUARY 16, 2003
7:00 P.M.



CALL TO ORDER

John Kareckas (Chairman), called the meeting to order at 7:23 p.m.

ROLL CALL

John Kareckas (Chairman), Bonnie Gould, Alan Schalk, Kevin DeSchuytner and Joseph Rousselle (Code Enforcement Officer).

QUORUM

There was a quorum with 4 voting members.  John Kareckas mentioned that Dave Kenny had a conflict of interest and therefore stepped down for this meeting.  None of the other members had a conflict of interest.

NEW BUSINESS

        Case #02-03
        August Realty, Inc.; Off Mountain Rd.
        Map 4 Lot 86; Administrative Appeal – No access from Town approved road

JURISDICTION

The Zoning Board of Appeals has jurisdiction pursuant to language used in Section 140-76. B2-B3 of the South Berwick Zoning Ordinance.  The appellant was denied a building permit because he has no access from a town approved road.

DETERMINATION OF STANDING

The appellant is August Realty, Inc., owner of property known as Map 4 Lot 86, located off Mountain Road.  Martin Parent is representing August Realty, Inc.  Mr. Parent is a principle (President) of August Realty, Inc.  

OTHER PARTIES TO THE ACTION

Abutters in attendance:  Brian and Heather Ruksznis of 57 Mountain Road; Map 4 Lot 81 and Arthur Thorner of 55 Mountain Road; Map 4 Lot 80A.  

TESTIMONY, QUESTIONING AND DISCUSSION OF EVIDENCE

August Realty, Inc. was denied a building permit due to having no access from a town approved road.  Mr. Parent said the cost of the road would be too much to warrant a house lot.  He showed an estimate dated January 11, 2003 from Dwayne Clement Construction showing a total of $20,000 to build a private road and an estimate from R&M Paving for $17,000.  John Kareckas named this Exhibit A#1.  Mr. Parent would like to be relieved from bringing the road up to town standards.  Mr. Parent had originally filled out the application as an administrative appeal in error.  What he wants is a variance.  Mr. Kareckas explained that Mr. Parent needs to be prepared to address the four criteria under variance appeals.  The Board discussed Mr. Parent submitting an amended application for a variance appeal.   

John Kareckas motioned to close the public hearing and have an amended application submitted no later than February 13, 2003.  Kevin DeSchuytner seconded motion.  All were in favor.  Motion passed.  Public hearing closed at 7:55.

The Board voted in favor of amended minutes 3-0.  Bonnie Gould abstained; she was not present at previous meeting.
